AIRBUS HELICOPTERS PHOTO CONTEST RULES

“2024 Calendar”

ARTICLE 1 - ORGANISATION


AIRBUS HELICOPTERS, a simplified company limited by shares, company registration: RCS Aix-en-Provence 352 383 715, registered address: Aéroport International Marseille-Provence, 13725 Marignane Cedex, France, is organising:
a free-to-enter photo contest with no purchase necessary. It will run from 15th May 2024 to 15th July 2023 as part of the design and production process for the AIRBUS HELICOPTERS 2024 civil and military calendars.


ARTICLE 2 – CONDITIONS OF ENTRY


2.1 - ENTRANTS

The competition is open to natural persons aged 18 and over, who are:
  • - acting on their own behalf as owners or operators of an AIRBUS helicopter
  • or
  • - acting on behalf of or representing a legal entity that is the owner or operator of an AIRBUS helicopter, provided that they have received authorisation from their relevant superiors to enter the contest.

Employees of the AIRBUS Group and anyone involved in the organisation of the contest are not permitted to participate.

2.2 – THE PHOTOGRAPHS
The submitted photographs must fall into the chosen theme for the competition. This is:
    Making missions possible

All photographs must feature one or more aircraft from the current AIRBUS HELICOPTERS range as included in the catalogue. The current range can be seen on the https://www.airbus.com/helicopters.html website under the heading “Our helicopter portfolio”.

The number of photographs is limited to three (3) per entrant (same name, same email address).

The type of helicopter featured in the photograph must be indicated in the entry form. It will determine whether, if selected as one of the thirteen (13) winning photographs for each calendar and irrespective of the theme selected, the photograph appears in the civil calendar or the military calendar. By entering the contest, the entrants expressly agree to this condition. Example: a winning photograph of an H125 civil aircraft will appear in the civil calendar and a winning photograph of an H145M aircraft will appear in the military calendar.
Entrants undertake not to submit photographs that are contrary to public morals or public policy or that infringe personal rights, are likely to infringe trade secrets or promote attitudes or situations that are potentially dangerous to aviation safety and/or the safety of people or equipment. In all cases such photographs will be excluded from the contest.

The submitted photographs must meet all of the following criteria:
  • - be in digital JPEG format (.jpg or .jpeg) and not exceed 30 MB (mega-bytes);
  • - have a minimum size of 3500 x 2400 pixels;
  • - ideally be in landscape format.


2.3 – TERMS AND CONDITIONS
Entrants will be able to submit their photograph(s) from 15th May 2024 at 12.00 pm until the end of the contest i.e. 15th July 2024 at 11.59 pm at the latest exclusively, by registering on the following website: https://www.airbushelicopters.com/events/photos_contest_2024/en/ref/home.html using the registration form provided and uploading their photograph(s) in the section corresponding to the theme of their choice (as per date and time of connection CET).

Photographs uploaded by entrants as their competition entries will be available for all to see on the dedicated competition webpage at: https://www.airbushelicopters.com/events/photos_contest_2024/en/ref/home.html.
All entrants agree to this condition.

All entrants will receive an email to confirm that their entry has been registered.

Entries registered after the date and time specified above will not be accepted. If you encounter any difficulty uploading your photographs, please check the size and format of your file. Please note that entry to the competition is free of charge.

Only photographs uploaded to:
https://www.airbushelicopters.com/events/photos_contest_2024/en/ref/home.html under the terms and conditions and using the procedure described in these rules will be accepted.

Entries will not be confirmed if the registration form has not been fully completed. Any registration form that is incomplete contains inaccurate information or fails to comply with these rules will be considered invalid. Any form of fraud or attempted fraud, false declaration or the provision of false name and address details will result in the entrant’s immediate elimination and, where applicable, the return of any prizes already sent out.

AIRBUS HELICOPTERS reserves the right to carry out any checks required to ensure compliance with the terms and conditions of entry set out in these rules.

As a general rule, failure to comply with the terms and conditions of entry set out in these rules will result in the invalidity of the entry in question.

AIRBUS HELICOPTERS reserves the right to exclude from the competition at any time and without notice any person conducting themselves in an unfair or improper manner in relation to this competition and its operation.

By entering the contest, you agree to comply without reservation with all the provisions of these rules, with the rules of conduct for internet users and with the legislation applicable to free competitions.


ARTICLE 3 – DESIGNATION OF WINNERS AND ATTRIBUTION OF PRIZES


3.1 – SHORTLISTING AND DESIGNATION OF WINNERS

A short list of one hundred (100) photographs will be drawn up by AIRBUS HELICOPTERS on the basis of the criteria set out below within fifteen (15) working days following the competition closing date. At the end of the short-listing process, an independent jury composed of seven (7) people will meet to select and rank thirteen (13) winning photographs for each calendar based on a mark out of twenty (20) awarded according to the following criteria:

Compliance with the theme of the contest /5

Originality of the photograph (notably but not restricted to the treatment of subjects/objects, type of mission, value of mission, etc.) /5

Photographic quality (notably but not restricted to sharpness, colour, composition, etc.) /5

Emotion aroused by the photograph /5

3-2 – ATTRIBUTION OF PRIZES

For the thirteen (13) photographs chosen per calendar from the one hundred (100) shortlisted photographs, AIRBUS HELICOPTERS shall reward to the winning entrants, be they natural persons who are owners or operators of an AIRBUS helicopter or to legal entities that are owners or operators of an AIRBUS helicopter and represented by a natural person acting on their behalf, by awarding them the following prizes:
  • - Publication of the winning photograph worldwide in the AIRBUS HELICOPTERS 2024 calendar (paper and digital versions);
  • - Dissemination of the winning photograph via the AIRBUS HELICOPTERS website and social media, notably Instagram, LinkedIn, Facebook;
  • - The award-winning photograph printed on hard support (plate) in A3 format;
  • - A personalized keyring for the Photo contest 2024;
  • - A LEGO® Technic construction kit from the AIRBUS H175 emergency helicopter.


One entrant may receive a prize for one or more photographs. A winner who receives a prize for two (2) or more photographs will receive the corresponding number of prizes.
AIRBUS HELICOPTERS reserves the right to change these prizes for other prizes of equivalent value and nature for any reason whatever without incurring any liability.

Winners should note that prizes are non-transferable, non-exchangeable and cannot be redeemed for cash or any other consideration of any nature whatever.

Winners must claim their prizes from AIRBUS HELICOPTERS within four (4) months after publication of the results on the AIRBUS HELICOPTERS website if they have not already received them. If a winner does not wish or is unable to take possession of his/her prize, he/she will not be entitled to any compensation of any nature.

Under no circumstances may AIRBUS HELICOPTERS be held liable if the contact details given at the time of registration are not those of the winner or are incorrect or should it prove impossible to contact the winner.


ARTICLE 4 – LIABILITY


Under no circumstances may AIRBUS HELICOPTERS be held liable for any IT problems encountered in uploading of the files containing the photographs, network congestion or malfunction due to external malicious acts that prevent the smooth transmission of the photographs.

AIRBUS HELICOPTERS may not be held liable for any failure to transmit photographic files by the competition closing date even in case of the circumstances detailed above. Photographs submitted in such circumstances will not be accepted.

AIRBUS HELICOPTERS reserves the right to cancel, defer, extend, cut short or modify the competition should the circumstances so require or for any other reason. It will neither be required to justify its decision nor incur any liability in this respect.

It should be noted that the entrant alone is responsible for ensuring that the information he/she provides when registering for the competition, in particular his/her contact details, are correct and truthful and that they will enable him/her to enter the contest and, where applicable, to take advantage of any prize that he/she may win.

ARTICLE 5 – PROCESSING AND PROTECTION OF PERSONAL DATA


AIRBUS GROUP undertakes to protect personal data in accordance with the General Data Protection Regulation (EU Regulation 2016/679) of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and with any applicable national data protection legislation.

Entrants are informed that any personal data about them collected in relation to this competition is strictly necessary to their entering the competition and that AIRBUS GROUP has put in place enhanced organisational and technical measures to ensure the safety of the data collected.

The data processed is intended for the use of AIRBUS GROUP personnel only.

Entrants enjoy a number of rights in relation to their personal data. These include the right to access their personal data, the right to rectification, to data portability, to erasure, to restriction of processing, to object and to lodge a complaint with the French data protection authority (Commission Nationale Informatique et Libertés, CNIL).

To exercise their rights and obtain communication of personal data about them, entrants should write to Airbus SAS, the data controller, by email at the following address: dataprotection@airbus.com or by post to: Airbus SAS, Head of Data Protection, HAP, 2 Rond-point Emile Dewoitine, 31700 Blagnac Cedex, France.

ARTICLE 6 – AUTHORISATIONS AND WARRANTIES


6.1 – ASSIGNMENT OF RIGHTS

By submitting their photographs, all entrants assign to AIRBUS HELICOPTERS, free of charge and non-exclusively, for worldwide use, the economic elements of copyright in the photographs, including the rights and purposes set out below, without exception or reservation, without restriction as to the quantity or number of disseminations, by any means present or future on any media and by any process current or future:

  • Non-shortlisted entrants: the rights to broadcast, publish, represent and reproduce in relation to the selection of the photographs shortlisted for this contest with effect from the date on which the photograph or photographs are submitted and for up to three (3) months after publication of the results regarding the shortlisted photographs;

  • Shortlisted entrants: the rights to broadcast, publish, represent and reproduce in relation to the selection of the photographs shortlisted for the contest and the selection of winners for this contest with effect from the date on which the photograph or photographs are submitted and for up to three (3) months after publication of the results regarding the winning photographs;

  • Winning entrants (prize winners): the rights to broadcast, publish, represent, reproduce, adapt, exploit and distribute in relation to the selection of the photographs shortlisted for this competition, the selection of winners for this competition, for the purpose of promoting its helicopters, services and, more broadly, its internal and external public relations activities in relation to this contest with effect from the date on which the photograph or photograph(s) are submitted and until December 31st 2024.

It should be noted that the photographs may be used on both physical and digital media.

The photographs may not be used for any purpose other than those set out above without the prior consent of the holder of the photographic rights. Entrants and AIRBUS HELICOPTERS undertake to come together to negotiate an extension to the term and area of exploitation initially agreed.

This assignment by entrants to AIRBUS HELICOPTERS constitutes an essential condition of entry to the competition. AIRBUS HELICOPTERS undertakes to cite the names of the authors of the photographs whenever they are used.

If AIRBUS HELICOPTERS uses their photographs, the winning entrants expressly consent to their being modified, cropped and/or accompanied by written comments as and when required for the layout of the calendar and/or its publication by AIRBUS HELICOPTERS on its website at
https://www.airbushelicopters.com/events/photos_contest_2024/en/ref/home.html

Entrants recognise that these rights are assigned free of charge and, in consequence, waive their right to any remuneration in respect of the use of their photograph or photographs in relation to this contest. Entrants recognise that AIRBUS HELICOPTERS may be obliged under no circumstance to publish the photographs.

6.2 – AUTHORISATION AND CERTIFICATION

Entrants warrant to AIRBUS HELICOPTERS that they hold all the intellectual property rights in the photograph or photographs submitted to enter this competition and that they have obtained, where applicable, any third-party authorisation required to permit AIRBUS HELICOPTERS to exploit and use the photographs freely and without interference. In any event, entrants are responsible for signing authorisations relating to image and property rights.

Entrants also warrant to AIRBUS HELICOPTERS that, where appropriate, the photographs have been taken in compliance with the rules governing confidentiality and safety applicable in the locations where they were taken.

Entrants authorise AIRBUS HELICOPTERS to use, free of charge, their first and last names and the towns and countries in which they live in communications relating to the organisation of this contest.

6.3 – WARRANTIES

By entering the contest, entrants warrant that they are the exclusive authors of the photograph or photographs they submit to enter the competition and/or that they hold all the rights and authorisations (see Article 6.2 above) required to permit AIRBUS HELICOPTERS to exploit the photographs submitted, and that the photograph or photographs do borrow from pre-existing works.

The entrants guarantee AIRBUS HELICOPTERS enjoyment without interference of the rights assigned under the terms set out in these rules and guarantee AIRBUS HELICOPTERS against any obstruction, legal action, claim, objection or third-party interference in respect of the ownership and/or exploitation of the photographs. The entrants undertake to ensure that these rights are observed and to indemnify AIRBUS HELICOPTERS, where applicable, against all founded claims and compensate them for any resulting costs payable by AIRBUS HELICOPTERS following such claims.

Entrants warrant to AIRBUS HELICOPTERS that in entering the contest they are not engaging in an activity that is illegal or contrary to public policy.

ARTICLE 7 – PUBLICATION OF RESULTS


The results of the competition and the names of the twenty-six (26) winners thirteen (13) winners per calendar will be announced on the competition page of the AIRBUS HELICOPTERS website at https://www.airbushelicopters.com/events/photos_contest_2024/en/ref/home.html no later than one month after their selection by the judging panel. The winners will be contacted individually to inform them of their selection. The winning photographs will then be disseminated on the AIRBUS HELICOPTERS website.

ARTICLE 8 – PUBLICISING THE COMPETITION


AIRBUS HELICOPTERS reserves the right to publicise the contest using various advertising methods including but not restricted its website at https://www.airbus.com/helicopters.html and social networks.

ARTICLE 9 – FILING OF THE RULES


A copy of these rules has been filed at the offices of SCP Guy Rosa, at 3 avenue René Dubos 13724 MARIGNANE, France.

AIRBUS HELICOPTERS reserves the right to change the rules. Any change in the rules will be set down in an amended version of the rules and filed at the address given above.

These Rules may be consulted throughout the term of the competition on the following website
https://www.airbushelicopters.com/events/photos_contest_2024/en/ref/home.html.. A written copy of the rules will be sent free of charge to any person who requests such a copy before the closing date of the competition.


ARTICLE 10 – APPLICABLE LAW - DISPUTES


These rules are governed by French law irrespective of the nationality of the entrants.

In case of a conflict of interpretation between the French- and English-language versions of these Rules, the French language version will take precedence.

In case of a dispute arising in relation to this competition and/or to the interpretation or performance of these Rules, claims must be made within fifteen (15) days following publication of the results and sent to AIRBUS HELICOPTERS by registered post with acknowledgement of receipt at the address below: AIRBUS HELICOPTERS, Aéroport International Marseille-Provence, 13725 Marignane Cedex, France.

No response will be made to claims made verbally.

If a complaint made to AIRBUS HELICOPTERS is unsuccessful, entrants who are consumers within the meaning of French law may take their dispute to a mediator, who will endeavour to bring the parties together in an independent and impartial manner with a view to reaching an amicable solution.

All entrants may take their case to the Centre de Médiation et d'Arbitrage de Paris (CMAP), 39 avenue Franklin D. Roosevelt, 75008 Paris, tel.: +33 1 44 95 11 40, email: cmap@cmap.fr using, amongst other methods, the form provided for this purpose on the www.cmap.fr website.

Entrants are free to accept or refuse recourse to mediation and, where the mediation route is chosen, each party is free to accept or refuse the solution proposed by the mediator. If an amicable agreement cannot be reached within two (2) months with effect from the date on which notice of the dispute is given, it will be referred to the relevant French courts.
